Introduction

Welcome to LeParadis.app. This End User Agreement ("Agreement") governs your use of our services, specifically for users that are booking and scheduling appointments, referred as End Users. This Agreement encompasses the End User's interactions with the Services, including but not limited to appointment scheduling, management, and payment processes.

By accessing or using our platform, you agree to be bound by this Agreement and confirm that you have the authority to enter into this Agreement. If you do not agree, please refrain from using our services. By using LeParadis.app, you acknowledge that you have read, understood, and agreed to this End User Agreement.

BY ACCEPTING THIS AGREEMENT, EITHER BY (I) CLICKING A BOX INDICATING END USER ACCEPTANCE; OR (II) BY EXECUTING AN ORDER FORM THAT REFERENCES THIS AGREEMENT; OR (III) BY DIGITALLY OR MANUALLY SIGNING THIS AGREEMENT, END USER AGREE TO THE TERMS OF THIS AGREEMENT. IF END USERS ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, END USERS REPRESENT THAT THEY HAVE THE AUTHORITY TO ENTER INTO THESE TERMS AND CONDITIONS. IF END USERS DO NOT AGREE WITH THESE TERMS AND CONDITIONS, END USER MUST NOT ACCEPT THIS AGREEMENT AND END USERS MAY NOT USE THE SERVICE.

Definitions

Service: Refers to the features, website, mobile applications, and content provided by LeParadis.app, including but not limited to all functionalities, tools, resources, and information available through the platform.

Business: This term signifies any individual or legal entity, along with its authorized Users, that subscribes to and utilizes the LeParadis.app Services to connect with their End Users.

End User: Refers to the individual or organization that accesses and utilizes the goods, services, or software provided under this Agreement. The End User is the final recipient of the product or service and may not distribute, resell, or provide access to the product or service to any third party without prior written consent from the Provider.

We, Us, Our: Refers to LeParadis.app, Le Paradis, LLC, and its operators, including any affiliates, partners, employees, and agents associated with the platform.

Direct Relationship Between LeParadis.app and End Users

The End User acknowledges that their interaction with LeParadis.app is solely for booking and scheduling appointments through our software under this End User Agreement. No other direct or legal relationship exists between LeParadis.app and the End User. All transactions related to payments, refunds, or cancellations for services provided by Business to the End User will be handled directly between the Business and the End User, in accordance with the terms and conditions established between them.

LeParadis.app will not be held responsible in any way for the commercial or legal relationship between Business and End Users, nor for how the Business collects, stores, and processes End User Data and Personal Information.

Changes to the Services

LeParadis.app retains the exclusive right to alter, modify, update, add, or remove sections of this Agreement at any time, with or without prior notice to End Users. It is the responsibility of End Users to regularly review this Agreement. LeParadis.app will inform End Users of modifications by posting them on this webpage and updating the "Last Updated" date at the top. All amendments will take effect immediately upon being posted. Continued use of the Services after any changes indicates acceptance of those modifications.

License Grant

LeParadis.app provides the End User with a personal license to access and utilize the Services in accordance with this Agreement. The End User agrees not to use, copy, modify, reformat, rent, lease, lend, frame, create derivative works from, publicly display, download, store, reproduce, transmit, link to, republish, upload, post, reprocess, make commercial use of, or distribute the Services, either in whole or in part. LeParadis.app maintains all rights not explicitly granted in this Agreement. The End User is responsible for their use of the Service and acknowledges that such use is at their own risk.

Use of the Services

The following activities are strictly prohibited on the LeParadis.app and represent clear violations of this Agreement:

Providing false information, engaging in fraudulent activities, or misrepresenting information related to your End User Account.
Attempting to access data that is not meant for you, such as logging into an unauthorized server or account.
Scanning or testing the security or configuration of our service, or attempting to breach security or authentication measures without proper authorization.
Interfering with the normal operation of any part, page, or area of the leparadis.app, including all functions and services offered by us.
Disrupting service to any user in any way, including, but not limited to, submitting a virus, or attempting to overload, flood, spam, mail bomb, or crash the services.
Distributing or transmitting materials that may be considered abusive, obscene, pornographic, defamatory, harassing, offensive, vulgar, threatening, or malicious by a reasonable person.
Disseminating, storing, or transmitting files, graphics, software, or other materials that infringe upon the copyright, trademark, patent, trade secret, or other intellectual property rights of third parties.
Using our Service or its content for advertising or solicitation for any commercial, political, or religious purpose, or to compete directly or indirectly with LeParadis.app.
Reselling or repurposing your access to the Leparadis.App or any purchases made via the LeParadis.app.
Utilizing our services or resources to solicit Site End Users, Business users, or other Business partners of LeParadis.app to join other competitive online or offline services, or aggregating current or previously offered services.
Exceeding or attempting to exceed purchase limits for gifts or using a LeParadis.app account to buy vouchers for resale, speculation, fraud, or other unauthorized purposes as outlined in this Agreement.
Taking actions that place excessive demand on our services or impose an unreasonable or disproportionate load on our servers or infrastructure, as determined solely by us.
Acting unlawfully or maliciously against the business interests or reputation of LeParadis.app, our Business Users, or our services.
Impersonating any individual or entity in order to access or utilize the Services.
Engaging in any other activity we consider contrary to the spirit or intent of this Agreement.
Using the Services in any illegal manner or in a way that is harmful to the Services.

End User Responsibilities

It is the responsibility of the End User to utilize the Services correctly. If the End User is unable to keep an appointment made through the Services, they agree to promptly inform the LeParadis.app with whom the appointment was scheduled. Additionally, the End User is accountable for all necessary equipment required to access the Services, which includes (but is not limited to):

A properly configured computer with broadband internet access;
A valid and functioning email address;
Any necessary software, including a compatible browser;
Any other equipment needed to access the Services.

Our Responsibilities

Leparadis.app is not required to provide assistance or support to the End User, which includes error corrections, upgrades, support, updates, bug fixes, enhancements, or any other form of assistance. The End User acknowledges that LeParadis.app has no liability or responsibility for the storage or deletion of any submissions made by the End User.

While LeParadis.app reserves the right to remove any User Submissions at its discretion and/or terminate a User Account without explanation or cause, it is not obligated to do so. We may monitor the End User's use of the Services, as permitted by law, to ensure compliance with this Agreement, fulfill legal obligations, or safeguard our rights and those of others.

Payments and Subscriptions

End Users acknowledge that their use of the Services is provided at no cost. Leparadis.app retains the right to modify the pricing structure and any related terms at any time, at its discretion. Any such changes will be published on the LeParadis.app Sites and will take effect immediately.

Payment Methods: Accepted payment methods will be outlined during the checkout process.

Payment Processing Fees

By using our services and making payments through our platform, you acknowledge and agree that all transactions processed via Stripe may incur processing fees. These fees are typically a percentage of the transaction amount, which may vary based on the specifics of the transaction.

As a user, you are responsible for any fees imposed by Stripe, and these fees will be deducted from the total amount processed. For the most current fee structure, please refer to Stripe's official pricing pagehttps://stripe.com/pricing.

By continuing to use our services and making payments, you agree to these terms and accept any applicable fees as outlined.

Termination

Upon the termination of the End User's use of the Services for any reason, all rights to access the LeParadis.app End User Account and utilize any part of the Services will immediately cease. In the event of such termination, the End User agrees to delete all of LeParadis.app's content from their hard drives and any other storage devices, and to destroy any copies of LeParadis.app's content in their possession.

Warranty Disclaimer

The Services are provided "AS IS," "WITH ALL FAULTS," and "AS AVAILABLE." The End User acknowledges that their use of the Services is at their own risk. Le Paradis, LLC does not guarantee that users will have uninterrupted access to the Services at all times or from all locations, that it will have sufficient capacity for all users, or that the Services will function properly with the End User's equipment.

To the fullest extent permitted by law, Le Paradis, LLC, along with its officers, directors, employees, and agents, disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, suitability, quality, accuracy, fitness for a particular purpose, and non- infringement.

Le Paradis, LLC makes no warranties or representations regarding the content of any websites linked to the Services. Le Paradis, LLC does not warrant, endorse, guarantee, or assume responsibility for any products or services offered, advertised, or provided by third parties through the Services or any linked websites, nor will Le Paradis, LLC be involved in or responsible for monitoring any transactions between the End User and any third party.

End Users are solely responsible for ensuring compliance with all applicable local laws.

Personal Information of End User

By using the Services, End User also consents and agrees to the terms of thePrivacy Policyonly to the extent where LeParadis.app collects and stores Personal Information of the End User directly for the provision of Services through our software.

Intellectual Property

LeParadis.app retains all rights to its intellectual property, including but not limited to copyrights, patents, trade secrets, trademarks, and service marks related to the Services (collectively referred to as "LeParadis Intellectual Property"). This intellectual property is solely owned by Le Paradis, LLC and/or its licensors, and no such rights are transferred to the End User.

Any content within the Services that contains or incorporates any of the LeParadis Intellectual Property cannot be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purpose without obtaining prior written consent from Le Paradis, LLC or the rightful owner, as applicable.

DMCA Notice

Le Paradis, LLC is committed to preventing and addressing unauthorized infringement of copyrighted materials. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, or if you have identified infringing material available through our Services, please notify our copyright agent in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"). For your complaint to be valid under the DMCA, please provide the following information in writing:

An electronic or physical signature of an individual authorized to act on behalf of the copyright owner;
Identification of the copyrighted work you claim has been infringed;
Identification of the infringing material and its location on our website;
Sufficient information to allow Le Paradis, LLC to contact you, including your address, telephone number, and email address;
A statement expressing your good faith belief that the use of the material in question is not authorized by the copyright owner, their agent, or applicable law; and
A statement made under penalty of perjury asserting that the information provided is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the State of Delaware.

Comprehensive Agreement / Translation / Interpretation

This Agreement, along with other legal policies available on the Leparadis.app and any operational rules for the Services set forth by Le Paradis, LLC, constitutes the complete agreement between Le Paradis, LLC and the End User regarding the End User's use of the Services. If any provision of this Agreement is deemed illegal or unenforceable by a court of competent jurisdiction, that provision will be modified as necessary to make it enforceable without altering its original intent, or removed from this Agreement if modification is not feasible. The remaining provisions of this Agreement will continue to be in full effect.

Limitation of Damages and Liability

UNDER NO CIRCUMSTANCES SHALL LEPARADIS.APP, ALONG WITH ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE HELD LIABLE TO THE END USER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM: (I) ERRORS, MISTAKES, OR INACCURACIES IN THE SERVICES CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND RESULTING FROM END USER'S USE OF THE SERVICES; (III) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR SUSPENSION OF TRANSMISSION TO OR FROM THE SERVICES OR ISSUES WITH INTEROPERABILITY; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR MALICIOUS SOFTWARE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY THIRD PARTIES; (VI) ERRORS OR OMISSIONS IN ANY CONTENT; (VII) USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL ACTIONS OF ANY THIRD PARTY; (VIII) THE END USER'S USE OR INABILITY TO USE ANY PART OF THE SERVICES, OR FOR ANY LOSS OR DAMAGE OF ANY KIND (INCLUDING LOSS OF END USER DATA) INCURRED DUE TO END USER'S USAGE OF THE SERVICES, REGARDLESS OF THE LEGAL THEORY INVOLVED (WARRANTY, CONTRACT, TORT, ETC.) AND WHETHER OR NOT LEPARADIS.APP WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL BE ENFORCED TO THE GREATEST EXTENT ALLOWED BY LAW IN THE RELEVANT JURISDICTION.
